Trust Our Industrial Accident Lawyers in Texas
At Shamieh Law, we know industry lives and breathes in Texas. Major manufacturers, such as Tesla, ExxonMobile, and Dell, all have headquarters in our state. Texas is home to many major oil and gas refineries, producing as many as 5.6 million barrels of refined oil a day, more than any other state. If you’ve been injured in an industrial accident in Texas, you need an experienced lawyer who understands both the law and the industry in which you were injured.
Though our firm’s Texas offices are located in Dallas and Austin, we represent injury victims across the state. We see how hard our state’s industrial employees work every day to keep things running, often in dangerous environments and difficult conditions. You’ve done more than your share—let us help you and your family in your hour of need.
It’s always best to hire an attorney after an industrial accident. The team at Shamieh Law can handle legal paperwork, put together a compelling case, and advocate for your best interest in settlement negotiations and in court. We offer free consultations and work on contingency, meaning you pay nothing unless we win your case. We’re an empathetic firm with a solid track record of high-value case results. Let us fight for you.
How We Approach Industrial and Explosion Accidents
Industrial accidents and explosions fall under the broad field of personal injury law, which covers civil lawsuits seeking compensation for injuries caused by the carelessness of others. Our legal team has decades of combined experience navigating this area of the law. In addition to our work on industrial accidents, we handle injury lawsuits in a wide variety of other practice areas.
Every case is unique and deserves the individualized attention of a skilled lawyer. Each personal injury case we take on at Shamieh Law begins with a free consultation. We then conduct a thorough, independent investigation of the circumstances and governing law. You can count on us to gather evidence, identify all liable parties, build a strong case on your behalf, negotiate a settlement, and take your case to court if the at-fault party refuses to compensate you fairly.
Which Industries Are Likely To Experience Industrial Accidents or Explosions?
Texas’s many industrial facilities contain heavy machinery, toxic chemicals, and numerous other workplace hazards, all of which can lead to serious industrial accidents. They can happen in virtually every industry, including:
- Oil and gas refineries
- Chemical plants
- Transportation of hazardous materials
- Aircraft, auto, and other machinery manufacturing
- Welding and metal manufacturing
- Pharmaceutical production
- Industrial woodworking
Regardless of the industry you work in, our Texas industrial accident attorneys can help you understand your legal rights.
Damages Available in Industrial and Explosion Accidents
There are three types of damages available through a personal injury lawsuit: economic, non-economic, and punitive damages.
Economic damages compensate for financial losses you suffered in an accident, including:
- Medical expenses
- Lost wages
- Property damage
- Lost earning capacity
Non-economic damages compensate for non-financial losses that don’t easily reduce to a monetary value, including:
- Physical pain and suffering
- Emotional distress
- Disability and disfigurement
- Loss of enjoyment of life
Unlike the compensatory damages listed above, punitive damages are awarded to punish defendants for egregious misbehavior and to deter others from engaging in similar misconduct in the future. Though rarer than compensatory damages, punitive damages can significantly raise the value of your case.
In Texas, punitive damages are capped at the higher of:
- $200,000
- Twice your economic damages, plus non-economic damages (not to exceed $750,000).
For example, if you were awarded $2 million in economic damages and $1.5 million in non-economic damages, punitive damages would be capped at $4,750,000 ($4 million in economic damages plus $750,000 in non-economic damages).
When Can I Sue for an Industrial Accident or Explosion Case?
In order to sue for damages sustained in an industrial accident or explosion, you normally need to prove that they were caused by negligence. This requires proving four elements:
- The defendant owed you a duty of reasonable care.
- The defendant breached that duty.
- The breach caused the accident.
- You suffered compensable damages as a result.
Other causes of action may also apply. However, no matter what legal theory underlies your claim, proving liability for industrial accidents is normally very complex. These cases require a close look at the facts, and chances are expert testimony will be required to sort out how the accident happened and who is at fault. Multiple parties may ultimately be liable, requiring your attorney to evaluate their comparative fault.
