Damages You Could Be Entitled to in Your Dallas Personal Injury Claim
We are dedicated to helping injury victims seek justice and accountability while fighting for the compensation needed to rebuild after an accident. While every case is different, the principle remains the same: you should be fully compensated for the harm caused by someone else’s negligence. Types of compensation our Dallas personal injury lawyers have helped clients recover include:
- Medical expenses: Reimbursement for past care and compensation for future treatment
- Lost wages: Including lost benefits, commissions, bonuses, and earning capacity
- Out-of-pocket expenses: Such as transportation to appointments or home modifications
- Pain and suffering: For the physical and emotional impact of your injuries
- Emotional distress: For the mental and psychological effects of the accident
- Wrongful death benefits: Available to dependents who have lost a loved one due to negligence
- Punitive damages: Rare but possible when the at-fault party acted with gross negligence
Your available compensation will depend on the nature and severity of your injuries, the circumstances surrounding the incident, and any shared responsibility.
How Is Your Personal Injury Settlement Calculated?
We calculate your personal injury settlement by reviewing all potential damages and applying a multiplier between 1.5 and 5, depending on the unique factors in your case. This number serves as a solid foundation for negotiating a fair settlement on your behalf.
At Shamieh Law, “Winning With Awareness” means we fight for meaningful results while staying focused on the people we serve. Every case is unique, and we take the time to develop a tailored legal strategy that suits your specific situation and needs.
Dallas Personal Injury Cases We Handle
Every injury case begins with a different story. Whether you were hurt in a collision or in a place you expected to be safe, we’ll look closely at what went wrong and assess who should be held responsible.
Car Accidents
Being injured by another driver can leave you paying for medical care while missing income because of a crash you didn’t cause. Our Dallas car accident lawyers can pursue compensation from the at-fault driver. We also handle Uber and Lyft accidents and hit-and-run collisions. If the driver was intoxicated, we can help you file a drunk-driving accident claim.
Truck Accidents
Electronic logbook data can show how long a truck driver had been on the road before a crash. Company records may also reveal maintenance problems or prior safety violations. Our Dallas truck accident attorneys can request this information and determine whether the driver or trucking company should be held responsible.
Motorcycle Accidents
Drivers sometimes say they didn’t see the motorcycle, even when they failed to check a blind spot or yield. Scene evidence and witness accounts can tell a different story, helping a Dallas motorcycle accident lawyer challenge efforts to shift blame onto the rider. The claim should also reflect how the injuries have affected your work and whether you can safely return to riding.
Wrongful Death
After a preventable death, families may hear from insurers while they’re still making funeral arrangements. A Dallas wrongful death lawyer can take over those conversations and investigate the circumstances that led to your loss. The claim can also seek compensation for the financial support your loved one would have provided and the personal loss your family has endured.
Premises Liability
Premises liability claims often hinge on whether a property owner had time to fix a dangerous condition or warn visitors about it. Prior complaints and repair records can help establish what the owner knew. That evidence can support a Dallas premises liability lawsuit arising from unsafe property conditions or inadequate security.
Slip and Fall Accidents
A spill can be cleaned up minutes after someone falls, and a damaged area could be repaired before the injured person returns. That doesn’t erase what happened. Surveillance footage and inspection logs can help a Dallas slip and fall lawyer establish how long the hazard existed and whether the property owner should have addressed it.
Catastrophic, TBI, and Burn Injuries
The first hospital bill captures only a small part of what a catastrophic injury can cost. Someone living with spinal cord damage or a traumatic brain injury might need help at home and might not be able to return to the same work. Severe burn injuries can also require additional procedures long after the initial wound has healed. We build these claims around the care and financial support the person is expected to need over time.
Construction and Industrial Accidents
An injured construction worker might assume workers’ compensation is the only available source of help. If a subcontractor or equipment company contributed to the accident, however, a separate third-party claim could be available. A Dallas construction accident lawyer can identify which businesses controlled the work and whether required safety measures were ignored. It’s possible that people hurt in industrial accidents could have claims against a company other than their employer.
Product Liability
If a product caused your injury, keep it in its current condition if you can do so safely. The item itself and the records behind its design can help a Dallas product liability attorney determine why it failed. We can use that evidence to identify the responsible company and document the harm the defect caused.
Daycare and Nursing Home Abuse
A young child or a nursing home resident may not be able to clearly explain how an injury occurred. Changes in behavior or inconsistent explanations from staff can give a family reason to question the care their loved one received. Facility records and witness accounts can help a Dallas nursing home abuse lawyer or daycare abuse attorney determine whether abuse or neglect occurred.
How a Dallas Personal Injury Lawyer Can Help Prove Negligence
To recover compensation in a negligence case, you generally need evidence showing that another party failed to use reasonable care and caused your injuries.
That proof isn’t always easy to find. Video can be erased, and witnesses’ memories can fade. Additionally, insurance adjusters often question whether the accident caused all your injuries or if you had a preexisting condition.
Shamieh Law begins with an independent investigation. Depending on what happened, we will preserve footage, speak with witnesses, or bring in an expert to explain how the accident occurred. We also use medical records and invoices to document how much the injury has cost you.
Because we understand why insurance companies may delay payment, we can anticipate common disputes and press for a response grounded in the evidence.
If You’re Partially at Fault for Your Injury, You May Still Have a Case
It’s natural to replay an accident and wonder whether something you did will prevent you from recovering compensation. Under Texas’s modified comparative negligence system, being partly responsible doesn’t automatically end your case.
You can still recover damages if you’re found 50% or less responsible, but your recovery will be reduced by your percentage of fault. For example, if your damages total $100,000 and you’re found 20% responsible, you could recover $80,000. If you’re found more than 50% responsible, you cannot recover compensation.
An insurance company may try to place more blame on you to reduce what it pays. We examine the facts behind that argument and push back when its version of the accident doesn’t match the evidence.

How Long Do You Have To File a Personal Injury Lawsuit in Dallas?
The Texas statute of limitations for personal injury cases is two years. This means you have two years from the date of your accident to file your injury or wrongful death lawsuit, or you may miss your opportunity to recover damages. According to Texas law, there are a few exceptions and extensions to the statute of limitations rule. For example:
- You have just six months to notify the government entity responsible for your injuries before you can file a lawsuit against the government.
- For accident victims under 18, the time limit to file a claim is two years from when the victim turns 18. However, medical malpractice victims under the age of 12 must file a claim by age 14.
- If the at-fault party leaves the state before you can file a lawsuit, the statute of limitations is paused until they return.
Keeping track of the applicable deadlines and identifying what limits apply can be crucial. For that reason, it is important to contact our Dallas personal injury lawyers as soon as possible to protect your right to seek compensation.
You Pay Nothing Unless We Win Your Personal Injury Case
At Shamieh Law, we believe the cost of quality representation should not hold you back from pursuing the compensation you need and deserve. We understand you may have lost your vehicle or your main source of income after an accident and could also be facing substantial medical bills.
We work on a contingency fee basis, meaning you don’t pay anything unless we win your case. In Texas, contingency fees are common agreements between the lawyer and the client in which the attorney does not collect a fee unless they win or settle the case.
The fee is typically calculated as a percentage of the compensation awarded. This arrangement allows clients with limited financial resources to access legal representation without paying out-of-pocket fees. In other words, you owe us nothing unless we win.
