What Damages Can You Recover in a Personal Injury Claim?
If you’ve been seriously injured in an accident, you may be entitled to compensation for a wide range of losses both financial and personal. At Shamieh Law, we help you pursue every category of damages the law allows.
Ramez Shamieh,
Owner and Personal Injury Lawyer
“In a personal injury case, there’s two main types of damages. There’s economic damages, which are your medical bills, both your past medical bills and any medical bills in the future, and also your lost wages, which can also be in the past and your future lost wages. And one of the ways we determine your future lost wages is by hiring an expert to come in and say for the rest of your life you’re not going to be able to earn X amount of money and that’s something we can compensate you for. Then there’s something called non-economic damages. Those are pain and suffering, mental anguish, physical impairment, which is physical limitations. So, for example, if you’re having trouble taking a shower or raising your arm, we can compensate you for that. Another damage is if you have burns or scars. The final damage would be loss of consortium. And what that is is that if you’ve lost a loved one or your loved one is paralyzed, you can be compensated for the loss of love that you’ve experienced. It’s so important to us that you understand all the aspects of your case.”
Economic Damages
These are the financial losses you’ve suffered as a direct result of your injury. Our team thoroughly documents these to make sure nothing is overlooked.
- Medical expenses (hospital bills, surgery, rehab, prescriptions)
- Future medical costs (ongoing care, therapy, surgeries)
- Lost wages (missed work during recovery)
- Loss of earning capacity (if your injury affects your long-term ability to work)
- Property damage (e.g., vehicle repairs or total loss)
- Out-of-pocket expenses (transportation to appointments, home modifications, etc.)
Non-Economic Damages
These damages reflect how the injury has affected your quality of life—things that don’t come with a receipt but matter just as much.
- Pain and suffering
- Emotional distress and mental anguish
- Loss of enjoyment of life
- Loss of companionship or intimacy (in wrongful death or serious injury cases)
- Physical impairment or disfigurement
Non-economic damages are often the most personal part of your claim. We take the time to understand your story and advocate for the compensation you truly deserve.
Punitive Damages
Punitive damages are awarded in cases where the defendant’s actions were especially reckless, dangerous, or intentional. These are not tied to your losses—they’re meant to punish wrongdoing and send a message.
Punitive damages may apply in cases involving:
- Drunk driving accidents
- Extreme safety violations at work
- Corporate negligence or cover-ups (like product defects or institutional abuse)
If your case qualifies, we will aggressively pursue punitive damages as part of your legal strategy.
How Much Will Hiring a Lawyer After an Accident Cost Me?
Most people assume they can’t afford a lawyer, but at Shamieh Law, you don’t pay us unless we win.
We work on a contingency fee basis. That means:
- No upfront fees
- No out-of-pocket costs
- You only pay if we win your case
We also help you get medical treatment without paying out of pocket. Many of our clients can see doctors through letters of protection, which allow you to get care now and pay later, once your case is resolved.
And yes, even if you are undocumented or don’t have a driver’s license, you still have rights.
Understanding Comparative Negligence in Texas
Even if you think you were partly at fault in an accident, you may still be eligible for compensation under Texas’s comparative negligence rule.
Here’s how it works:
- You can recover damages as long as you were less than 51% at fault.
- Your compensation is reduced by your percentage of fault.
For example, If a jury finds you 20% at fault in a car crash and awards $100,000, your recovery would be $80,000.
Insurance companies often try to shift the blame to reduce what they owe. That’s why having a legal team that knows how to challenge these tactics like Shamieh Law is essential.
How Long Do I Have to File a Claim?
Texas law gives you two years from the date of your accident to file a personal injury lawsuit. But waiting is risky.
Evidence can disappear, witnesses move away, and insurance companies get tougher the longer you wait. If you were hurt in Grapevine, don’t delay call Shamieh Law now and get the process started.
