What Can ICE Do? From An Immigration Lawyer’s Perspective

Ramez: We hear all kinds of ridiculous things that ICE is doing to put fear in people like showing up to football games, showing up to people’s houses. Is what they’re doing legal? And if if not, what are the things they’re doing legal and what are the things you think they’re doing, you know, unconstitutionally?
Jordan: Yeah. So, this has been a common point of contention. Um, what they are doing illegally is they have to they can’t enter your home. If they’re knocking on your door, they have to announce their presence. They can’t enter your home legally without a warrant. So, if they do knock on your door, do not let them in unless they have a warrant. They can’t uh unlawfully search and seize you, your person, anything on you. Um, what they are doing legally is is really again up up for debate. They are stretching the law as far as possible and trying to get away with anything that they can to detain individuals and expedite expeditiously remove them from the country.
Ramez: What do you think this government, this administration is trying to do to people as it relates to immigration?
Jordan: It’s a good question. I think I think the administration is just trying to stoke fear in foreigners who are here because the president has promised to his base to keep it white evangelical Anglo-Saxon base here in America and he’s trying to stoke fear into the foreigners that are here to hopefully get them to leave voluntarily. Now, if they don’t leave voluntarily, they are stretching the law as far as possible to forcibly remove them. So, I think he really is just trying to strongarm them and and make this a country of of of non-immigrants when immigrants really are the reason this country is so great.
