If I’m in a Car Accident and the Other Party Doesn’t Have Insurance, Can I Have a Case?

Video Transcript

[Music] If the other party doesn’t have insurance, you can still go after them personally. Just keep this in mind. We can go to trial and get any amount of money in the judgment against the at-fault party. But if they don’t have money, there’s no way to compensate you for your injuries. Now, sometimes the at-fault party doesn’t have insurance and there’s a crime that was committed during the incident, and so the state that you’re in, either Texas or Louisiana, can pursue criminal actions on your behalf and the public at large against the at-fault party. And we see this when it involves drunk driving or when it involves reckless behavior such as high speeds or chasing down the road or road rage where it’s intentional conduct. And so we separate the two. We handle the civil matter whereas the state would handle the criminal matter. And it really depends on whether or not this person has money to go after. And that’s something we’ll advise you and make sure you understand all of your rights so that you’re protected. [Music]
