$5M Arbitration Award For Wrongful Death After Retail Worker Murdered

I want to tell you a little bit about a $5 million settlement my firm obtained for some clients. Our client, who is deceased now, was working at a small retail location. Gunman came in and shot up the entire place, and she had complained to management that her place wasn’t secure and that she requested security and they turned a blind eye. They chose profits over safety. Now, you would think that somebody’s life would be worth even more than $5 million. And here’s the tough part. The client signed an arbitration agreement. And what that means is that the case does not go to a jury trial, it goes to an arbitrator. And the arbitrator typically gets hired by defense attorneys. So they have an incentive to not pay out a lot of money. But with the results we got at mediation for $5 million, the family was ecstatic, they were happy, and they felt justice was served. And we avoided giving the decision to an arbitrator who may have awarded a lot less money. So this is something that we do normally.
